Welcome to CodeInk. Please read these Terms of Service carefully before placing an order or using our website. By accessing codeink.art or purchasing from us, you agree to be bound by these terms.

These Terms of Service, together with our Shipping Policy, Return & Refund Policy, and Privacy Policy, form the complete agreement between you and CodeInk.

Section 1 — About CodeInk

CodeInk is an independent art studio based in Québec City, Canada, operated as a sole proprietorship. We produce original and commission-based artwork using precision pen plotter robots and archival ink on fine cotton paper.

Throughout these Terms, "we", "us", and "our" refer to CodeInk. "You" refers to the customer placing an order or visiting our website.

All orders are fulfilled from Québec City, Canada. These Terms are governed by the laws of the Province of Québec and the applicable laws of Canada, including the Loi sur la protection du consommateur (L.R.Q., c. P-40.1) and the Canada Consumer Product Safety Act.

Section 2 — The Nature of Our Products (The Plotter Clause)

Please read this section before ordering. It is fundamental to understanding what you are purchasing.

CodeInk does not produce digital prints, laser prints, or mass-manufactured reproductions. Every piece is drawn in real time by a precision pen plotter robot — a machine that physically moves an ink pen across cotton paper, line by line, exactly as a human hand would, but with mechanical consistency.

The Perfection of Imperfection

This is our philosophy and our promise. Every CodeInk piece carries the honest marks of its own making. What might appear to be imperfections are, in fact, the proof that your piece was drawn — not printed, not copied, not manufactured.

The following are normal and expected characteristics of pen plotter art. They are not defects:

  • Line weight variation — The pen nib responds naturally to drawing speed and pressure. Lines may vary slightly in thickness, particularly at the start or end of a stroke.

  • Ink accumulation points — Small deposits of ink may appear where the pen pauses, lifts, or changes direction. This is an inherent behaviour of liquid ink.

  • Micro-splatter — Occasional microscopic ink dots near areas of high line density are a natural result of liquid ink on cotton fibre paper.

  • Overlapping lines — At corners, curves, and intersections, lines may cross or overlap by fractions of a millimetre.

  • Paper texture — Fine art cotton paper has a natural grain and surface character that may be visible under directional light. This is a feature of the medium, not a flaw in the piece.

  • Paper breathing — Cotton paper may show slight undulation after ink is applied, as the natural fibres respond to moisture. This is a characteristic of archival paper and does not affect the structural integrity or longevity of the artwork.

  • Micro-deviation on long lines — On continuous lines exceeding a significant length, a deviation of less than 0.5mm may occur. This is imperceptible at normal viewing distance.

  • Variation between editions — No two plotter-drawn pieces are identical. Minor differences between copies of the same design are intrinsic to the process and are precisely what makes each piece an original.

These characteristics are not grounds for a return, refund, or replacement claim. They are what separates a CodeInk piece from a mass-produced poster.

The following DO constitute genuine defects and are covered under our Return & Refund Policy:

  • Lines missing or interrupted across a significant portion of the design, caused by pen failure or mechanical error

  • Incorrect design produced (wrong coordinates, wrong name, wrong layout relative to what was agreed)

  • Artwork arriving wet, torn, bent, or structurally damaged due to shipping

  • Wrong ink colour used relative to what was confirmed at time of order

  • Extensive ghost lines or blank sections caused by complete pen failure during production

Section 3 — Orders & the Production Process

3.1 Made-to-Order

Every CodeInk piece is produced specifically for you after your order is placed. We do not hold inventory of finished artwork. Production begins within 1–2 business days of order confirmation.

3.2 Custom & Personalized Orders

For orders requiring customization — including specific coordinates, personal names, dates, inscriptions, or images provided by you:

  • You are responsible for the accuracy of all information submitted. Please review your order confirmation carefully. CodeInk will reproduce your specifications as submitted.

  • We will flag obvious inconsistencies. If submitted data appears evidently incorrect (for example, coordinates that place a location in the middle of an ocean for a city map), we will contact you before proceeding. However, this courtesy review does not transfer responsibility for accuracy from you to us.

  • Digital proof. For custom portraits and complex commissions, we will send a digital proof for your review and approval before production begins. Once you approve the proof, production starts and no further changes can be made to the design.

  • Your approval constitutes acceptance of the design as shown. Claims regarding design elements clearly visible in and approved via the digital proof will not be eligible for remedy.

3.3 Standard Collection Orders

Standard, non-personalized pieces from our open collection are subject to availability and standard processing times of 2–4 business days before shipping.

Section 4 — Pricing & Payment

All prices on codeink.art are displayed in Canadian dollars (CAD) unless otherwise specified. Applicable taxes will be calculated and displayed at checkout based on your delivery address.

CodeInk accepts payment through the secure methods available at checkout. By placing an order, you confirm that you are authorized to use the payment method provided.

Prices are subject to change without notice. The price applicable to your order is the price displayed at the time your order is confirmed.

Section 5 — Shipping & Delivery

Shipping terms, estimated transit times, tracking, customs responsibilities, and our process for lost or damaged shipments are detailed in our Shipping Policy, available at codeink.art/shipping-policy.

Our estimated production time is 2–4 business days before shipping. This is separate from carrier transit times. During high-volume periods (Black Friday, Christmas, Valentine's Day), production may extend to 5–7 business days.

Section 6 — Returns, Refunds & Cancellations

Our complete return and refund terms are set out in our Return & Refund Policy, available at codeink.art/return-and-refund-policy.

Our craft guarantee: If your piece arrives damaged or does not match what was agreed and confirmed, we will redraw it at no cost to you. No bureaucracy. No lengthy process. Just a new piece, drawn right.

Nothing in these Terms or our Return & Refund Policy limits or waives your rights under the Loi sur la protection du consommateur du Québec or other applicable consumer protection legislation.

Section 7 — Intellectual Property

7.1 CodeInk Original Designs

All original designs created by CodeInk — including our Blueprint Series, geometric collections, and any design conceived and executed entirely by CodeInk — are the exclusive intellectual property of CodeInk and are protected under the Loi sur le droit d'auteur (Canada).

Purchasing a physical CodeInk piece grants you a personal, non-transferable licence to display, photograph, and enjoy the artwork for personal, non-commercial purposes. This licence does not grant you the right to:

  • Reproduce, scan, or digitize the artwork for commercial purposes

  • Resell the artwork as your own design or creation

  • Use the artwork as the basis for a competing commercial product

  • Publish the artwork in any commercial context without prior written permission from CodeInk

Personal use — including photographing your piece for social media, sharing it online, or using it as a personal reference — is expressly permitted and encouraged.

7.2 Commission-Based & Personalized Works

For pieces produced on commission using your personal photos, coordinates, or other content you provide:

  • CodeInk retains the copyright in the artistic expression embodied in the final drawn piece — the specific aesthetic interpretation, linework style, composition, and execution.

  • You retain all rights to the underlying content you provided (your photographs, personal data, etc.).

  • CodeInk grants you a broad personal licence to display, frame, photograph, and share your commissioned piece, including on social media, without restriction.

  • CodeInk may use images of completed commissions for portfolio, marketing, and social media purposes unless you expressly request otherwise in writing at the time of ordering.

7.3 Reference-Based & Derived Works

Some CodeInk designs — particularly technical blueprint interpretations of aircraft, vehicles, vessels, and architectural subjects — are artistic interpretations developed using reference materials from public domain sources, Creative Commons-licensed works, or commercially licensed design resources that permit derivative works.

In all such cases:

  • The reference material used is either in the public domain or licensed under terms that permit commercial derivative works

  • CodeInk's artistic blueprint interpretation constitutes a substantially transformative creative work

  • CodeInk asserts copyright over its specific creative expression, aesthetic treatment, line composition, and visual interpretation

  • CodeInk makes no claim to ownership of any underlying reference material, technical specifications, or factual information about the subject depicted

Section 8 — Electronic Commerce & Distance Contracts

CodeInk sells goods through an online store, which constitutes distance contracts (contrats conclus à distance) under the Loi sur la protection du consommateur du Québec. In accordance with applicable requirements:

  • Seller identity: CodeInk, Québec City, Québec, Canada. Contact: info@codeink.art

  • Description of goods: Pen plotter artwork on fine art cotton paper, produced on demand

  • Price: Displayed in CAD at checkout, inclusive of applicable taxes

  • Payment methods: As displayed at checkout

  • Estimated delivery: Production 2–4 business days + carrier transit time as per Shipping Policy

  • Your right to remedies: Where applicable under the LPC, you retain rights to resolution, replacement, or refund in the circumstances described in our Return & Refund Policy

Section 9 — Limitation of Liability

To the maximum extent permitted by applicable law, CodeInk's total liability to you for any claim arising from or related to your order shall not exceed the amount paid by you for the specific order giving rise to the claim.

CodeInk is not liable for indirect, incidental, or consequential damages, including loss of enjoyment, loss of anticipated use, or loss of a gift occasion, except where such limitation is prohibited by applicable consumer protection law.

This limitation does not apply to claims arising from CodeInk's gross negligence, wilful misconduct, or as otherwise required by the Loi sur la protection du consommateur.

Section 10 — Privacy & Personal Data

CodeInk collects and processes personal information in accordance with our Privacy Policy, available at codeink.art/privacy-policy, and in compliance with Québec's Loi modernisant des dispositions législatives en matière de protection des renseignements personnels (Law 25) and applicable federal privacy legislation.

By placing an order, you consent to the collection and use of your personal information as described in our Privacy Policy, including for order fulfilment, communication regarding your order, and, if you have opted in, marketing communications.

You have the right to access, correct, or request deletion of your personal information. To exercise these rights, contact us at info@codeink.art.

Section 11 — Modifications to These Terms

CodeInk reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Your continued use of our website or placement of an order after changes are posted constitutes your acceptance of the revised Terms.

The Terms in effect at the time of your order are the Terms that govern that order.

Section 12 — Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Province of Québec, Canada, and the applicable laws of Canada.

In the event of a dispute, we encourage you to contact us first at info@codeink.art. We are committed to resolving any issue fairly, promptly, and without unnecessary formality. If a resolution cannot be reached directly, disputes shall be subject to the jurisdiction of the competent courts of the Province of Québec.
